Jeffrey represented a driver who, along with some 50 others, was accused of driving up a motorway the wrong way ...a very serious offence which could easily have had tragic consequences for all involved.

The difference in this case, was that our client instructed us that he was diverted to using this route by a uniformed police officer!

The case was listed for trial and, as a result of some expert sleuthing, we discovered that our client was not the only driver facing similar allegations that day; in fact there were approximately 50 drivers who found themselves in that situation.

One of the key skills that any good defence solicitor has is ‘disclosure’, which is effectively pressing the prosecution for answers and knowing which buttons to push in order to extract that information.

We needed to know the identity of the officer, the cause for the diversion, how many other drivers were involved, and access to the officer’s notes.

The CPS ignored our initial requests and then we received the information in dribs and drabs, until finally they conceded and withdrew the allegation two days before trial (despite the fact that they had been in receipt of our requests for months).

Our client was left with legal fees to pay, which cannot be reimbursed under current rules brought in by this government, and a feeling that he was not told the whole story.

Additionally, we later discovered that many of the other 50 drivers either pleaded or were found guilty and probably faced calls for disqualification, large fines, and/or points on their licence.
