Gary Conway represented an individual who faced an allegation under section 357(3) of the Insolvency Act 1986, of dissipating funds pre-bankruptcy. This is an allegation that is rarely prosecuted and should invariably result in an immediate custodial sentence. Not this time, thanks to Gary’s diligent and immaculate preparation of our client’s case which ensured that a raft of detailed mitigation was put before the Court. The client received a community punishment order and avoided prison.
