Miles Herman and Jeremy Ornstin of counsel ably represented an individual charged with offences of possessing information likely to be useful to persons committing or preparing an act of terrorism and having explosives on an aeroplane, namely distress signals.
This was a particularly complex case which was handled with extreme care from the police station until conclusion. With the offences being made out, it was critical to prepare the case on the basis of why this defendant had possession of these items and not for the furtherance of terrorist acts.
Following charges being preferred, Miles set about taking instructions relating to the background of this case, meeting frequently with family members who were able to provide helpful material and, in doing so, showed excellent client care throughout.
As a result of meticulous preparation, Miles and Jeremy drafted a favourable basis of plea that the prosecution agreed to in part. This laid the groundwork for subsequent legal arguments and the Court, clearly persuaded by the defence submissions as to disposal, felt able to impose a suspended prison sentence.
This was a remarkable outcome and is undoubtedly one of the very few cases prosecuted by the Terrorism Unit of the CPS to result in a non-custodial sentence.
The client and his family were naturally delighted by the outcome.
