Fiona Grandy and James Stansfeld of Counsel dealt with a case in which approximately 17 years had elapsed since client had committed the offence – too long considering she was not a fugitive of the state. Poland should have acted more quickly and the Court was not persuaded that her extradition was not oppressive or disproportionate. The substantial unexplained delay, her ill health, and her settled life in the UK meant extradition would be disproportionate.

2. Fiona, together with Nicholas Hearn of Counsel, dealt with a matter in which, although the client was a fugitive, there was an unexplained delay of many years on the part of the Polish authorities. The balance fell in favour of the requested person. Extradition was a disproportionate interference with his Article 8 rights and those of his family.
