Miles Herman represented a defendant who faced charges relating to the importation of cigarettes and tobacco pouches.

It was alleged by the Crown that, if the pouches had been forwarded and sold on, the excise duty evaded would have been in excess of £1.3 million. Prison sentences in the region of three years and upwards are routinely handed out for cases of this nature.

Following a guilty plea, Miles, assisted by Jeremy Ornstin of counsel, prepared effective and significant mitigation on behalf of this defendant. The Court felt able to suspend an inevitable prison sentence. The client was extremely delighted and relieved at avoiding prison.
